(AP) ? Tina Curl was so eager to see her 9-year-old daughter's killer executed Tuesday night that she couldn't even take her seat in the witness room.

"I was right up to the glass," she told The Associated Press after the execution. "I wanted to see it up close."

Donald Moeller, 60, received a lethal injection at the South Dakota State Penitentiary in Sioux Falls on Tuesday night as punishment for the 1990 kidnap, rape and killing of young Becky O'Connell.

Curl, who said Moeller's death brought her relief but not closure, had been steadfast in her wish to watch Moeller die, even raising funds to cover her expenses to make the 1,400-mile trip from her home in New York state to Sioux Falls for the execution.

Late Tuesday she said she will never return to South Dakota.

Moeller kidnapped Becky from a Sioux Falls convenience store where she'd gone to buy sugar to make lemonade at home. He drove her to a secluded area near the Big Sioux River, then raped and stabbed her. Becky's naked body was found the next day; investigators said her throat had been slashed.

After the execution, Curl showed pictures of Becky at 9 years followed by a framed drawing of how she might have looked had she lived to age 32.

Curl said she wanted to know details from Moeller about the crime. She had written to him in prison, but he didn't respond. She was hoping to get that information Tuesday night in Moeller's final statement.

But when asked if he had any last words, Moeller replied, "No sir," and then looked up and said, "They're my fan club?" It's not clear who Moeller was referring to as his fan club.

Moeller then was administered a lethal injection of pentobarbital and took about eight heavy breaths before his breathing stopped and Moeller turned slightly pink.

Moeller's eyes remained open as his skin turned ashen, then purple. The coroner then checked for vital signs, and Moeller was pronounced dead at 10:24 p.m.

Gov. Dennis Daugaard said he hoped the execution would bring some peace to Becky's family and he commended Warden Doug Weber and his staff for their professionalism in planning this state's second execution in less than a month.

"I take no pleasure in his death, but there are those who are so vile that executions are warranted," Daugaard said in a statement.

Moeller initially was convicted in 1992, but the state Supreme Court overturned it, ruling that improper evidence was used at trial. He was again convicted and sentenced to die in 1997. The state Supreme Court affirmed the sentence, and Moeller lost appeals at the state and federal levels.

Though he fought his conviction and sentence for years, Moeller said in July he was ready to accept death as the consequence of his actions. He admitted for the first time in court that he killed the girl.

But even as Moeller insisted he was ready to die, several motions were filed on his behalf to stop the execution despite his protests.

Earlier this month, a federal judge dismissed a pending suit challenging South Dakota's execution protocol after Moeller insisted he wanted no part of it. Moeller also distanced himself from a motion filed by a woman with loose family ties who argued that his decades in solitary confinement had made him incapable of voluntarily accepting his fate. That motion was dismissed Monday.

Moeller's execution came just two weeks after the Oct. 15 execution of Eric Robert for killing South Dakota prison guard Ronald "R.J." Johnson during a failed escape attempt.

Before that, the last execution in South Dakota was in 2007, when Elijah Page died by lethal injection for the murder of Chester Allan Poage, who was abducted and killed in a scheme to burglarize his mother's home.

In 1947, George Sitts was electrocuted for killing two law enforcement officers. And in 1913, Joseph Rickman was hanged for the murder of a woman and her daughter.

They were among 17 inmates executed since 1877, the oldest of which came during the days of the Dakota Territory.

Winter Driving Safety ? Surviving Motherhood

I thought with all the talk of SNOW possibly on Halloween and with what was happening off the coast (prayers going to them!), this was a great time for this post. STAY SAFE!!!

It?s that time of year again. We?re dusting off our woolly hats, digging out the wellies and braving the elements. Although we?d all like to be tucked up in bed with a cup of hot cocoa, there are times when we just can?t avoid taking the car out. UK-based company, Pass Smart, have created a guide to driving safely this winter. From what to keep in your boot, to advice for driving in snow, this guide includes everything you need to know to keep you and the littles ones safe this winter.

Checking your car!

Making sure your car is in tip-top condition is the very first thing to do as winter approaches. If you?re not sure what to look for, ask a family member or friend to have a look for you. You?ll need to check:

Headlights and tail lights are working

All tires (including the spare) are in good condition, with enough tread and pressure

The brakes are working well

The screen-wash bottle is full

Other fluids, such as oil and anti-freeze, are topped up to the correct levels

Be prepared

During the winter months, when adverse weather is on the cards, you should always have an emergency kit in your boot. It?s recommended that you have:

A tow rope

A flashlight

A shovel (you can buy compact, foldable shovels to preserve space)

High visibility vests

A blanket

First aid kit

De-icer and scraper

Warm clothes

Food & drink supplies, such as water (in a flask to prevent it from freezing) and some non-perishable food

You should also make sure that you take supplies for the kids when going out with them in the car. Some cereal bars, baby milk and jars of baby food are a god idea. Unless it?s essential they come with you, however, don?t travel ? in particularly bad weather ? with the kids in the car.

Plan your journey

Plan your route before you set off. Taking main roads is the safest option, as they?re more likely to have been gritted. If you can avoid treacherous roads, do so, even if it makes your journey longer.

Check local weather and road reports so that you know what to expect, and only drive if absolutely necessary.

It?s a good idea to tell someone what time you expect to reach your destination. Tell them you?ll ring them when you get there, or if you?re visiting someone, give them an estimated time of arrival. Make sure your phone is fully charged, so you can pull over and give them a call if you?re late.

Driving in snow and ice

When driving in snow and ice, making gentle maneuvers is vital. Stopping distance is increased by up to ten times in ice and snow, so drive slowly and don?t do any harsh braking. If your car starts to skid when braking, take your foot off the brake. Continuing to brake will only make the skid worse.

In an automatic vehicle, lock the transmission into 2nd gear, making you less reliant on the brake and limiting your speed.

If you find yourself stuck in the snow, it?s time to get the shovel out! (I bet you thought you?d never use it). Put something ? an item of clothing or old floor mat ? in front of the front tyres for some grip, and try to pull away. If you?re stuck in a dangerous place, get the kids out of the car and stand well away from the vehicle. Call a recovery truck if you need to.

Most importantly, remember to stay alert, be prepared and avoid driving at all unless absolutely necessary. Keep you and the little ones safe this winter; wrap up, get cosy and enjoy the snow safely!

Smart as a bird: Flying rescue robot will autonomously avoid obstacles

ScienceDaily (Oct. 30, 2012) ? Cornell researchers have created an autonomous flying robot that is as smart as a bird when it comes to maneuvering around obstacles.

Able to guide itself through forests, tunnels or damaged buildings, the machine could have tremendous value in search-and-rescue operations. Small flying machines are already common, and GPS technology provides guidance. Now, Ashutosh Saxena, assistant professor of computer science, and his team are tackling the hard part: how to keep the vehicle from slamming into walls and tree branches. Human controllers can't always react swiftly enough, and radio signals may not reach everywhere the robot goes.

The test vehicle is a quadrotor, a commercially available flying machine about the size of a card table with four helicopter rotors. Saxena and his team have already programmed quadrotors to navigate hallways and stairwells using 3-D cameras. But in the wild, these cameras aren't accurate enough at large distances to plan a route around obstacles. So, Saxena is building on methods he previously developed to turn a flat video camera image into a 3-D model of the environment using such cues as converging straight lines, the apparent size of familiar objects and what objects are in front of or behind each other -- the same cues humans unconsciously use to supplement their stereoscopic vision.

Graduate students Ian Lenz and Mevlana Gemici trained the robot with 3-D pictures of such obstacles as tree branches, poles, fences and buildings; the robot's computer learns the characteristics all the images have in common, such as color, shape, texture and context -- a branch, for example, is attached to a tree. The resulting set of rules for deciding what is an obstacle is burned into a chip before the robot flies. In flight the robot breaks the current 3-D image of its environment into small chunks based on obvious boundaries, decides which ones are obstacles and computes a path through them as close as possible to the route it has been told to follow, constantly making adjustments as the view changes. It was tested in 53 autonomous flights in obstacle-rich environments -- including Cornell's Arts Quad -- succeeding in 51 cases, failing twice because of winds. The results were presented at the International Conference on Intelligent Robots and Systems in Portugal Oct. 7-12.

Saxena plans to improve the robot's ability to respond to environment variations such as winds, and enable it to detect and avoid moving objects, like real birds; for testing purposes, he suggests having people throw tennis balls at the flying vehicle.

The project is supported by a grant from the Defense Advanced Research Projects Agency.

Lesbian and Gay Relationships | Tim's Blog ? Just One Train Wreck ...

I have gay relationships. I have lesbian relationships too. I think God is pleased.

There seem to be quite a few people in my profession who fall into one of the LGBTQQ categories ? lesbian, gay, bisexual, transgender, queer, questioning. In fact, our professional association created an LGBT Section a few years ago, much like we have sections for people with other common identifiers (such as ethnicity). The opening reception for the LGBT Section was at one of the association?s midyear conferences a while back, and I was there with a friend of mine who organized the formation of this new group. He even declared me an auxiliary member, since I was hanging out with him as he greeted the other members. Not that auxiliary membership actually exists, but if it did I?d be a shoe-in.

Why was I there? Because, like I said,?he?s a friend of mine.

He is one of the people I am closest to, not too far behind my wife in that regard. We call each other up when things are on our minds and we need to talk. In fact, he called last night and my wife and I put him on speaker phone so we could all chat as we made dinner. He?d heard that our daughter?s car got totaled and since she lives 10 minutes from him but 8 hours from us, he?offered to loan her his car. He and I borrow sweatshirts from each other when it?s cold. He and his husband have dinner with me and my family. Getting together is rarer than we?d like, since?we live at opposite ends of the state, but when we do see each other it commences with a hug. Go ahead and call it an intimate friendship. I do.

I also spend time with other gay and lesbian colleagues from up and down the state. We serve on committees together, make dinner reservations if we?re at the?same conferences, and support one another. One of them is even a person I turn to for prayer support at times, as she does me.

As I said, I have lesbian and gay relationships and I think God is pleased.

You see, Jesus spent time with people who were on the margins ? the woman at the well in John 4, Zacchaeus the?tax collector in Luke 19, the woman caught in adultery in John 8,??the woman who used her own hair to wipe her tears from Jesus? feet in Luke 7, to name a few?- and?he wasn? concerned with how it looked to the upright religious leaders around him.

Why do I identify with my lesbian and gay friends? Because I think Jesus would have.

My friends know my faith. It comes up in conversation often. Jesus talked to his friends and acquaintances about God;?so do I. In fact, as odd as it may seem, I actually find it easier to do so with these particular friends than with others sometimes.

And let?s face this fact too. Even though my colleagues have reached the pinnacle of their profession, they can still be marginalized at a moment?s notice. Each and every one of them is always a hair?s breadth away from?unfair discrimination and downright bullying. Make no mistake about it, it is still dangerous to be homosexual in America.

These are my friends. I like them and find them a pleasure. I think they feel the same about me.

I also love them. I think Jesus does too.

Jesus said to them, ?It is not the healthy who need a doctor, but the sick. I have not come to call the righteous, but sinners.? (Mark 2:17.)

[Jesus also said,] ?The Son of Man came to seek and to save the lost.? (Luke 19:10.)

My friends aren?t so different from me. They need Jesus. So do I.

Stacy Mitchell: 6 Small Business Issues at Stake in This Election

A number of critical small business issues are at stake in next month's federal and state elections. Here are six of the most important.

1. Restructuring the Banking System

Nearly half of all small businesses have been unable to secure adequate financing, according to recent surveys. Even as the economy recovers, lending is unlikely to improve significantly because the problem is largely structural. Big banks, which increasingly dominate the banking system, do relatively little small business lending. Since 2007, the share of bank assets held by the largest 18 banks grew from 52 to 60 percent. Meanwhile, small and mid-sized banks, which provide most small business loans, have been losing ground. Over 900 of these banks have disappeared since 2007, casualties of the recession and government policy responses that have favored big banks.

What to look for in Congressional candidates:

  • Supports the SAFE Banking Act, which would cap the size of banks and force the largest banks to be split up.

Presidential positions: Romney has said that he does not support breaking up big banks. The Obama Administration opposed an amendment to the Dodd-Frank financial reform law that was similar to the SAFE Banking Act.

What to look for in candidates for state offices:

  • Supports depositing public funds with local banks. The state of Massachusetts, for example, has spurred 2,500 new small business loans in the last year by moving $278 million in public funds to local banks.

  • Favors creating a public partnership bank similar to the Bank of North Dakota, which has expanded the lending capacity of local banks and thereby made credit more available for local businesses. Bills to create state partnership banks have been introduced in many states.

Flying Air Conditioners: A Minor Study in Risk Assessment

Hurricane Sandy is hurtling toward the East Coast and has already brought high winds and heavy flooding to the region. Will it also blow your air conditioner out of the window? Daniel Engber examined the evidence last August as Hurricane Irene approached, noting that while hurricane-force winds could damage ACs, removing them from windows is a virtually risk-free endeavor. His original piece is printed below.

window AC unit

Should you leave your AC in the window or take it out?

I've never appreciated advice from strangers, and I'm getting plenty of it. Email chain letters, mostly, forwarded from a guy in New Orleans or a girl from Galveston, someone who's lived through a few of these tropical storms in his or her day, and now deigns to provide a few hurricane tips for me and you and all the other friends-of-a-friend-of-a-friend on the Internet. I've been told to stay indoors (seems boring), tape my windows (seems futile), purchase gallons of bottled water (seems heavy), and remove the air-conditioning unit from my window (seems humid). I'm happy to ignore all these unwanted words of advice?that was my plan, at least?but the last did begin to nag at me Friday afternoon. I love my air conditioner; it's my very favorite appliance. Am I really at risk if I leave it untouched? Or, more awful to think about, could my A/C be in danger, too?

I checked online and found doomsayer-talk of air-conditioners flying out of windows, or shooting across bedroom floors, or becoming so damaged by the rain and wind that they no longer functioned. Yes, it would be a pain to uninstall the 81-pound unit?but maybe, just maybe, worth the effort.

Then came the announcement from the mayor, calming words before the storm: "Michael Bloomberg discouraged people from removing air-conditioning units," reported the New York Times' City Room blog on Friday, "saying any benefits could be easily be outweighed by units accidentally falling into apartments or out of the window."

Finally, an unambiguous message from someone I trust. The technocrats at City Hall had run the numbers?they'd placed risks and benefits side-by-side, activated the relevant statistical software, and determined that we'll all be better off if my A/C stays in the window and I stay on my couch.

One anxiety begets another, though. What numbers went into this municipal calculation, I wonder. How did the mayor work through the costs and benefits? Was he saying that the chance of an Irene-related air-conditioner accident was close to zero? Or did he mean to imply that the chance of an air-conditioner-removal accident was even higher?

It's not an idle question. I'm not planning to uninstall my dearly beloved LW1211ER this weekend, but summer's almost over. I'll be stowing the unit away in another two weeks, maybe three, and thousands more New Yorkers will do the same. Maybe it's tens of thousands, or hundreds of thousands: We install and remove our window units every late spring and early fall. So what's the death toll from this yearly rhythm?

Mayor Bloomberg seems to presume that if we take out our units for Hurricane Irene, we'll be doubling the risk, whatever it is. (Another round of installations and removals would give us twice the opportunity to drop our appliances on babies and old people, I presume.) There are a number of flaws in this logic. First, it seems unlikely that many of those who removed their A/Cs for the storm would be inclined to reinstall them right after, less than a week before Labor Day. In that case, we'd have done little more than pushed the late-summer ritual of removal a few days earlier. Second, wouldn't the hours leading up to the arrival of Hurricane Irene provide the best, safest opportunity to do that yearly maintenance? How many people are going to be out on the street this afternoon, passing under my window as the storm clouds gather? With so few pedestrians below, won't the dangers be halved?

There's an even better reason to doubt the mayor's math, though. Despite a cottage industry in overcautious accoutrements?window netting and the like?the urban air-conditioner seems to pose only the barest danger to those on the sidewalk. A recent media survey conducted by the Village Voice found just a handful of falling-A/C incidents, and when the newspaper asked the Department of Buildings for comment, they were told that "accidents involving air conditioners are rare in New York City."

Sure, there was the 67-year-old man who was struck last year as he walked his shih tzu down Second Avenue. And the 24-year-old man battered by a unit in New Jersey. Back in 2006, a 51-year-old woman had her leg shattered, her pelvis broken, and her ribs fractured by a falling A/C. There have been some cases in other big cities, too?a "freak accident" near London's Waterloo Station, another hit in Chicago. But there isn't much evidence that these exceedingly rare events have much to do with the actual installation or removal of the units. A sloppy job might cause an appliance to fall eventually, I suppose, but so could a rotting window frame or a bolt of lightning.

Also interesting, if not quite to the point, is the fact that these air-conditioner tragedies are almost never fatal. The Voice couldn't find a single confirmed death in its survey. Even the New Jersey man, whose clobbering arrived from 15 stories above, seems to have weathered the insult just fine. (If anything, it's falling the other way that's the problem?like the mentally-handicapped 12-year-old boy who apparently dropped out of his bedroom window along with an air-conditioner in February 2007.) Somehow it doesn't kill you when a giant box of metal strikes you unexpectedly in the head. I find that comforting.

Which leaves me to assume that it's not really that dangerous to remove your air conditioner, this weekend or next weekend or the one after. The major costs in these cases, it seems, are the multimillion-dollar lawsuits that inevitably follow. That's why I've decided that if I leave my unit in place, and it's damaged in the storm, I'll be taking Bloomberg to the cleaners.

(AP) ? The city of San Francisco cleaned up Monday after a rowdy World Series celebration turned violent in some neighborhoods and police arrested three dozen people.

The majority of arrests occurred in the Mission District, and included two people on gun charges, police Sgt. Michael Andraychak said.

"There were celebrations all over the city, and they were all peaceful and upbeat," Andraychak said. "Unfortunately, as the night progressed, this other element emerged and were intent on doing violence."

Bonfires of trash were lit in several intersections around the city, and a public transit bus was torched. Windows of several businesses and vehicles were broken, including a news van.

Firefighters needed a police escort to douse a bonfire near the Giants' ball park. They also fought fires fueled by couches, news racks and other debris throughout the city.

Police said a damage report was not yet available.

Mayor Edwin Lee announced a ticker-tape parade would be held at 11 a.m. Wednesday from Market Street to Civic Center Plaza.

A parade after the Giants won the series in 2010 drew hundreds of thousands of fans.

After the game ended Sunday, fans across the city left their televisions and rushed outside, greeting diners, bar patrons and other merrymakers Sunday night after the Giants defeated the Detroit Tigers 4-3 to sweep the Series for their second title in three years.

In the city's Polk Gulch neighborhood, hundreds of fans sprayed champagne, set of off firecrackers and blocked traffic for at least two hours after the game.

Several blocks away, police clad in riot gear looked on as revelers danced around Civic Center plaza where they had watched the game on a Jumbotron.

The thousands of fans assembled at the site exploded in a roar with the final out.

Anthony Yos, 10, hugged his brother Luciano Yos, 15, and the two danced in an embrace with their parents.

"This is the greatest thing," Anthony said with a smile that could go no wider. "The Giants are my favorite team."

Someone in the crowd launched fireworks a few minutes after the game. Strangers hugged strangers, and wine bottles and marijuana cigarettes were shared freely despite a heavy police presence.

"This is San Francisco, "said Laura Chu. "We know how to party."

Sara Vivas brought her 6-year-old daughter Briana Cepeda from Oakland to view the game and join the celebration. They were both clad head-to-toe in Giants garb.

"This is something she will remember forever," Sara said.

Sandy: East Coast braces for epic hurricane, ?life-threatening? storm surge

Waves crash into a pier in Nags Head, N.C., Oct. 27, 2012. (Gerry Broome/AP)

"Superstorm." "The Perfect Storm." "Frankenstorm."

Whatever you want to call it, the East Coast is bracing for Hurricane Sandy, an epic, "rare hybrid storm" that is expected to bring "a life-threatening storm surge" to the mid-Atlantic coast, Long Island Sound and New York harbor, forecasters said early Sunday, with winds expected to be at or near hurricane force when it makes landfall sometime on Monday.

According to the National Hurricane Center, the Category 1 storm is currently centered about 260 miles southeast of Cape Hatteras, N.C., and 395 miles south of New York City, carrying maximum sustained winds of 75 mph and moving northeast at 10 mph.

Sandy is expected to continue on a parallel path along the mid-Atlantic coast on Sunday before making a sharp turn toward the northwest on Monday--with New York City in its projected path.

But the path is not necessarily the problem.

"Don't get fixated on a particular track," the Associated Press said. "Wherever it hits, the rare behemoth storm inexorably gathering in the eastern U.S. will afflict a third of the country with sheets of rain, high winds and heavy snow."

A tropical storm warning has been issued between Cape Fear to Duck, N.C., while hurricane watches and high-wind warnings are in effect from the Carolinas through New England. The hurricane-force winds extend 175 miles from the epicenter of the storm, while tropical storm-force winds extend 520 miles--making Sandy one of the biggest storms to ever hit the East Coast.

"We're looking at impact of greater than 50 to 60 million people," Louis Uccellini, head of environmental prediction for the National Oceanic and Atmospheric Administration, told the Associated Press.

[Related: Superstorm could impact 60 million]

"The size of this alone, affecting a heavily populated area, is going to be history making," Jeff Masters wrote on Weather Underground blog.

New York Governor Andrew Cuomo announced the suspension of all MTA service, including Long Island Railroad and Metro North, beginning at 7 p.m. Sunday. Mayor Bloomberg "is considering evacuating parts of New York City," Gov. Cuomo said.

New Jersey Governor Chris Christie ordered a shutdown of the state's casinos.

"I can be as cynical as anyone," Christie said on Saturday. "But when the storm comes, if it's as bad as they're predicting, you're going to wish you weren't as cynical as you otherwise might have been."

Similar emergency evacuations were being mulled by state officials in Connecticut, Massachusetts, Vermont, New Hampshire and even Maine.

"This is not a coastal threat alone," said Craig Fugate, director of the Federal Emergency Management Agency, said during a media briefing early Sunday. "This is a very large area."

[Also read: Big storm scrambles presidential race schedules]

Forecasters also fear the combination of storm surge, high tide and heavy rain--between 3 and 12 inches in some area--could be life-threatening for coastal residents.

According to the National Hurricane Center summary, coastal water levels could rise anywhere between 1 and 12 feet from North Carolina to Cape Cod, depending on the timing of the "peak surge." A surge of 6 to 11 feet is forecast for Long Island Sound and Raritan Bay, including New York Harbor.

The storm surge in New York Harbor during Hurricane Irene, forecasters noted, was four feet.

Did US go too far in its secret surveillance of citizens?

Critics say the Bush-era law designed to collect foreign intelligence intrudes on the constitutionally protected privacy and free speech rights of US citizens. The US Supreme Court hears the case Monday.

The US Supreme Court on Monday is set to hear oral argument in a case examining whether Americans have legal standing to file a lawsuit challenging the constitutionality of a US surveillance program designed to vacuum up millions of international telephone and email messages to mine for critical intelligence.

The secret program, begun under the Bush administration, uses bottlenecks in the telecommunications system to collect telephone conversations and emails that might help the government collect ?foreign intelligence.?

The problem, according to privacy experts, is that the massive electronic collection effort is not limited by individualized warrants issued and overseen by federal judges. The new surveillance program is more general. It can sweep up the international phone calls and emails of Americans, particularly those who communicate with potential targets of US intelligence who are overseas.

How much do you know about the US Constitution? A quiz.

It is that prospect that led a group of lawyers, human rights advocates, and journalists to file a lawsuit in 2008, asking a federal judge to declare the surveillance program unconstitutional.

They argued that their work requires them to engage in sensitive phone conversations and emails with colleagues, clients, journalistic sources, witnesses, experts, and victims of human rights abuses overseas.

They say they have a reasonable belief that the US program will record, retain, and facilitate analysis of their private, privileged communications. In some instances, they say, they decided to forego the use of the phone and email, and instead traveled overseas ? at considerable expense ? to undertake sensitive conversations in person to insure they would remain privileged and private.

Justice Department lawyers counter that the plaintiffs? claims are merely speculative, since they have offered no proof that any of their communications have been intercepted or would be intercepted in the future. In addition, the government says it is under no obligation to disclose whether such surveillance has taken place. The secrecy of the program is justified as necessary to protect US national security.

The central issue at this stage of the litigation isn?t whether the broad surveillance program violates privacy, free speech, or other constitutional principles. At this stage, the issue is whether the plaintiffs have suffered a concrete injury that a judicial decision can remedy.

Without such an injury, the plaintiffs are not entitled to use the courts to resolve their dispute.

The doctrine of standing is designed to prevent lawyers from using the courts to air mere disagreements over policy.

The plaintiffs say their injuries are substantial and more than justify the court?s involvement.

A federal judge disagreed and dismissed the lawsuit. A federal appeals court panel reversed that decision, ruling that the plaintiffs faced a real and immediate threat that their communications would be intercepted by the government.

The appeals court, the Second US Circuit Court of Appeals in New York City, said the additional burdens and expenses of traveling overseas to preserve the confidentiality of their communications amounted to an actual injury that conferred standing to file the lawsuit.

It is that appeals court decision that is now before the Supreme Court.

A Big-Picture View ? | Swing Trading

Often, it pays to step back from the markets and take a bigger picture view, by way of monthly charts. In today?s video update, I do just that. For gold, silver, the dollar and the Dow.

You will see something very interesting. QE III, or unlimited money-printing by the Fed, isn?t doing all that much, even for the markets.

In today?s video, I also explain why.

P.S. If you truly want to be positioned correctly in gold for its next lift-off to $5,000-plus, I strongly recommend you consider a membership to my Real Wealth Report. That?s where you will get every one of my timing signals to buy gold, silver, mining shares, resource-based income investments and more.

Video Transcript

Good morning! This is Larry Edelson with my Uncommon Wisdom video market update for Monday, October 29.

Today we?re going to step back from the markets and take a look at the monthly charts rather than the short-term gyrations that are occurring in the markets.

They?ve all been largely trading sideways with a lack of interest by most investors as we come very close now to the elections, which are keeping a lot of investors and traders basically just trying to scalp the markets or stay out of the markets altogether.

But there have been, in the last week, some significant changes in the markets. And you really can only see them by way of the monthly charts. So today we?re going to take a look at those monthly charts.

Gold: Here is the monthly chart for gold. As you can see, last week gold did hit resistance at the upper level here and has now turned lower.

This is very significant. It is what I?ve been expecting all along.

Most importantly, it is pretty amazing that ? given QE III to infinity and unlimited money-printing by the European Central Bank (ECB) and the Federal Reserve ? gold was unable to get above this channel resistance here and is now turning lower.

I?ve said all along that this was a bearish signal that gold could not take out the earlier high this year and last year?s November high. And as you can see, gold was unable to do that despite unlimited money-printing.

Why? Because the de-leveraging that?s occurring around the world right now is overpowering even unlimited money-printing.

So we?re not there yet for the breakout in gold. The next leg up in gold will not occur until the money-printing that?s occurring leaks out into the economy.

Right now it?s basically sitting in banks and investment banks and going back to the Federal Reserve in the way of excess deposits, excess reserves put back on the Federal Reserve?s balance sheet, and it?s doing nothing for the economy.

So you?re not seeing the wave of inflation that everyone expects. It will come, but we?re not there yet. It probably won?t come until the sovereign-debt crisis fully impacts the United States and until the Federal Reserve forces banks to start lending again. And they do have several tools to do that.

They have not employed them yet so beware anybody who tells you that the Fed is out of ammo; that?s not the case. I?ve written about this extensively before.

We?re just not at that point yet where all this money-printing is causing an increase in the velocity and turnover of money and credit and causing inflation.

Silver: Let?s take a look at the monthly chart of silver. You?ll see pretty much the same thing here.

Yes indeed we did get a rally, but silver was unable to even test resistance let alone take out its previous high earlier this year and, of course, the reaction high back in 2011. This is pathetic action in silver. And silver is indeed now starting to break down.

I still believe that silver is going to plummet through $26 and head down to $22-$21. I know I have been wrong on my timing there but I am not going to be buying silver for the next run-up ? the next bull phase in silver ? until we see a cyclical test of support around the $20-$22 level.

That will likely happen over the next few months, so please be aware of that.

U.S. Dollar Index: I find this awfully interesting as well. The dollar is largely going sideways but with a slightly upward bias.

Given QE III, you would think that the dollar would be plummeting to record lows. It?s not. It?s the flipside of the gold argument.

The dollar is holding its own because there?s so much de-leveraging going on in Europe and movement out of the euro and other currencies around the world into cash, which by default means the dollar. So that?s causing the dollar to have a sideways to slightly higher trading band to it.

I do expect we?re going to see a torrid rally in the dollar coming very soon where we?re going to see it project higher ? up to around the 92 level basis on the Dollar Index.

Dow Industrials: The Dow Industrials on a monthly basis give you a very good indication of what?s happening here.

The Dow Industrials is firm. There?s no question about that. That is a sign of its underlying long-term strength.

But here, too, QE III has done nothing to cause the Dow to explode to new highs.

We?re still under important resistance here and the Dow is starting to look like it?s going to penetrate support at the 13,200 level. Once that happens, once we solidly penetrate support at 13,200, we can get a significant pullback in the U.S. stock markets. And I still expect that to happen.

Longer-term, I expect the Dow and the S&P 500 to inflate higher along with gold and commodities. But we?re not there yet. We?re not going to get there until all the money-printing that?s being done by the Fed starts to work its way out into the economy, and that?s not happening right now. Please keep that in mind.

Have a good week. I?ll talk to you again soon.
